Terms of Service
These Terms of Service ("Terms") govern your use of the Geeked-Out Basketball website, game, and related services (together, the "Service"), operated by Geeked-Out Games LLC ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who Can Use the Service
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, and purchases must be made by that parent or guardian.
You're responsible for your account: keep your password secure, and let us know right away at jamie@geekedoutgames.com if you believe your account has been compromised. You may not share, sell, or transfer your account.
2. The Service
Geeked-Out Basketball is a basketball simulation game. We're actively developing it, which means features may be added, changed, rebalanced, or removed over time — including gameplay mechanics, attributes, and simulation behavior. Portions of the Service (such as online community features, leaderboards, and multiplayer) depend on our servers and an internet connection, and may occasionally be unavailable due to maintenance or technical issues.
During pre-release phases (such as alpha, playtests, and betas), the Service is provided for testing and feedback: bugs are expected, and saved progress may occasionally be reset or altered as part of development. We'll try to avoid that, but can't promise it.
3. Purchases, Subscriptions, and Virtual Items
Products. We may offer one-time purchases (such as game editions and content packs) and recurring subscriptions (monthly or annual) that provide access to online features. Prices, product contents, and availability are described at the point of purchase and may change over time (changes won't retroactively take away something you've already bought).
Payment. Purchases are processed by our third-party payment processors. By purchasing, you agree to their terms as well. You must have the legal right to use the payment method you provide.
Subscriptions. Subscriptions renew automatically at the end of each billing period (monthly or annual) until canceled. You can cancel at any time via your account or the payment processor's customer portal; cancellation stops future renewals, and you keep access to subscription features until the end of the period you've already paid for.
Refunds.
- One-time purchases: refundable within 14 days of purchase, provided the purchased content has not been substantially used or redeemed (for example, a content pack that has been opened/applied is not refundable).
- Subscriptions (monthly and annual): refundable in full within 14 days of the initial purchase if the subscription features have not been substantially used. After 14 days, subscription payments are non-refundable; canceling stops renewal and your access continues to the end of the paid term. We do not provide prorated refunds for unused time.
- To request a refund, email jamie@geekedoutgames.com from the email associated with your account.
- Nothing in this policy limits any non-waivable refund rights you may have under the laws of your place of residence.
Virtual items and in-game content. Content packs, virtual items, in-game currency (if any), and similar digital content are licenses, not property: they grant you a limited, revocable, non-transferable right to use that content within the Service. They have no real-world monetary value, cannot be sold, traded, or exchanged outside the Service, and are not redeemable for money.
4. User Content
Parts of the Service may allow you to submit or upload content — for example, custom team names, logos, court designs, player images, feedback, and community posts ("User Content").
Your ownership. You keep whatever rights you have in your User Content.
Your license to us. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, adapt (for example, resizing or reformatting), and distribute that content for the purposes of operating, providing, promoting, and improving the Service. This license lasts as long as your content remains on the Service, plus a reasonable period for backups, and survives for content that has been shared with or is in use by other users.
Your promises about your content. You represent that you own or have the necessary rights to everything you upload, and that your User Content does not infringe anyone's intellectual property, publicity, or privacy rights. Do not upload content you don't have the right to use — including copyrighted logos, trademarks, or images of real people without permission.
Our rights. We may review, moderate, remove, or refuse any User Content at our discretion, including content we believe violates these Terms or harms the Service or its users.
Feedback. If you send us ideas, suggestions, or feedback about the Service, we may use them without restriction or compensation.
5. Acceptable Use
You agree not to:
- Break the law or infringe others' rights while using the Service;
- Upload content that is unlawful, infringing, hateful, harassing, sexually explicit, or otherwise objectionable;
- Cheat, exploit bugs for unfair advantage, use automation/bots to play, or manipulate leaderboards or community features;
- Attempt to gain unauthorized access to the Service, other users' accounts, or our systems;
- Reverse engineer, decompile, or extract the source code of the Service except where that restriction is prohibited by law;
- Scrape, harvest, or collect data from the Service or other users at scale without our written permission;
- Resell, rent, or commercially exploit the Service or any content within it without our written permission;
- Interfere with the operation of the Service, including by imposing an unreasonable load on our infrastructure.
We may investigate violations and may suspend or terminate accounts that violate these Terms (see Section 8).
6. Our Intellectual Property
The Service — including the game, its code, simulation engine, design, artwork, logos, and all content we create — is owned by Geeked-Out Games LLC and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial entertainment purposes, subject to these Terms. All rights not expressly granted are reserved.
Streaming, video creation, and other community content: you're welcome to create and monetize videos, streams, and similar content featuring GOB gameplay, provided the content doesn't imply our endorsement, doesn't provide access to the game itself, and otherwise complies with these Terms.
7. Third-Party Services
The Service may link to or interoperate with third-party services (payment processors, video platforms, social networks, and app stores or distribution platforms such as Steam). Those services have their own terms and privacy policies, and we're not responsible for them. If you obtain the game through a third-party platform, that platform's terms also apply to your purchase and use through that platform.
8. Termination
By you: You can stop using the Service and/or request account deletion at any time by emailing jamie@geekedoutgames.com.
By us: We may suspend or terminate your access to the Service (or any part of it) if you materially violate these Terms, if required by law, or if we discontinue the Service. For violations, where practical we'll give you notice and a chance to fix the problem first — but serious violations (such as cheating that affects other users, unlawful content, or attacks on the Service) may result in immediate suspension or termination.
If your account is terminated for violating these Terms, you don't get a refund for purchases or unused subscription time. If we discontinue the Service entirely or terminate your access without cause, we will provide a pro-rated refund of any prepaid subscription time as your exclusive remedy.
Sections that by their nature should survive termination (including Sections 4, 6, 9, 10, and 11) survive.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT SAVED DATA WILL NEVER BE LOST. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEEKED-OUT GAMES LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction — except that either party may bring an individual claim in small-claims court, and nothing here limits rights you may have under the mandatory consumer-protection laws of your place of residence.
Before filing any claim, you agree to contact us at jamie@geekedoutgames.com and give us 30 days to try to resolve the issue informally.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll post the updated Terms with a new effective date and, where appropriate, notify you by email or in-Service notice. Changes apply going forward; your continued use of the Service after changes take effect means you accept them. If you don't agree to updated Terms, stop using the Service and contact us about your account.
13. Miscellaneous
These Terms (together with the Privacy Policy and any purchase-specific terms presented at checkout) are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision isn't a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
